1. Terms of website and application use

This page (together with the documents referred to in it) tells you the terms on which you may use this website or application, or any website or application operated by Radius Limited or under our control (our platforms). Please read these terms of use carefully before you start to use any of our platforms, as by doing so, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our platforms.

www.radius.com is a website operated by Radius Limited (we). We are a limited company registered in England and Wales under company number 08260702 and we have our registered office at Eurocard Centre, Herald Drive, Crewe, CW1 6EG.

4. Changes to these terms

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as these are binding on you.

5. Changes to our platforms

We may update any of our platforms from time to time and may change the content at any time. Any of the content on our platforms may be out of date at any given time, and we are under no obligation to update such material. If the need arises, we may suspend access to our platforms or close it indefinitely.

We do not guarantee that our platforms, or any content on them, will be free from errors or omissions.

6. Accessing ourplatforms

Access to our platforms is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our platforms without notice. We will not be liable to you if for any reason any of our platforms is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our platforms.  You are also responsible for ensuring that all persons who access our platforms through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Where applicable, if you choose, or you are provided with, a user identification code or password as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.  We have the right to disable any user identification code or password at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of service.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at Contact | Radius.

7. Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our platforms, and in the material published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way from our platforms, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our platforms must always be acknowledged.

You must not use any part of the content on our platforms for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our platforms in breach of these terms of use, your right to use our platforms will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

8. No text or data mining or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our platforms or any services provided via, or in relation to, our platforms for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our platforms or any data, content, information or services accessed via the same.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

9. Rules about linking to our platforms

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our platforms in any website that is not owned by you.

Our sites must not be framed on any other site, nor may you create a link to any part of our sites other than the home page.

We reserve the right to withdraw linking permission without notice.

10. Reliance on information posted

The content on our platforms is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our platforms.

Although we make reasonable efforts to update the information on our platforms, we make no representations, warranties or guarantees, whether express or implied, that the content on our platforms is accurate, complete or up-to-date.

11. Our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our platforms or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our platforms;
  • use of or reliance on any content displayed on our platforms;
  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or

12. Viruses, hacking and other offences

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our platforms or to your downloading of any content on it, or on any platform linked to it.

You must not misuse our platforms by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our platforms, the server on which our platforms are stored or any server, computer or database connected to our platforms. You must not attack our platforms via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you may commit an offence under applicable law. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our platforms will cease immediately.

Where our platforms contains links to other websites, applications and resources provided by third parties, these links are provided for your information only and are accessed entirely at your own risk. We do not endorse those websites, applications or resources, have no control over the contents of those websites, applications or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

15. Jurisdiction and applicable law

The English courts have exclusive jurisdiction over any claim arising from, or related to, a visit to our platforms although we retain the right to bring proceedings against you for breach of these terms in your country of residence or any other relevant country. These terms are governed by English law.
